Using FormBuddy

Terms of Use

These terms form an agreement between you and Nikhil Nelson, and apply when you use the FormBuddy Android app. By downloading or using the app, you agree to them. If you do not agree, do not use FormBuddy.

Who you are contracting with

Our full registered address is on record with the Government of India and can be verified against the GSTIN above using the GST portal's taxpayer search. We will supply it in writing on request. Legal notices may be sent by email to the address above, and we will confirm a postal address for service where one is required.

“We,” “us,” and “our” refer to Nikhil Nelson. FormBuddy is operated as a sole proprietorship, not a company.

Eligibility

FormBuddy is intended for adults. You must be at least 18 years old to use the app. By using FormBuddy you confirm that you are 18 or over and legally able to enter into this agreement. If you are under 18, do not use FormBuddy. We may terminate access where we learn this requirement is not met.

Fitness guidance, not medical advice

Exercise involves risk. Use a safe space and stable device setup. Stop immediately if you feel pain, dizziness, shortness of breath beyond normal exertion, or discomfort. Seek professional advice before exercise if you have a health concern, injury, pregnancy, disability, or uncertainty about whether an activity is suitable. You are responsible for deciding whether an activity is appropriate for you.

Movement estimates

Repetition counts and form cues are automated estimates. Accuracy can vary with lighting, clothing, camera position, visibility, device capability, and individual movement. Do not rely on FormBuddy for medical, safety-critical, competitive, or professional certification decisions.

Acceptable use

You may use FormBuddy for personal, lawful fitness activity. Do not reverse engineer, interfere with, abuse, redistribute, or use the app in a way that harms others, devices, services, or intellectual-property rights.

Licence and intellectual property

FormBuddy, its interface, artwork, and original content are owned by Nikhil Nelson or used under applicable licenses. These terms grant a personal, revocable, non-transferable, non-exclusive right to install and use the app on devices you control; they do not transfer ownership. Third-party components remain subject to their own licences.

FormBuddy Premium

Premium is a one-time, non-consumable digital purchase handled by Google Play. The Play purchase screen shows the applicable price, currency, and any taxes before you confirm. Prices may change for future purchases, but a completed one-time purchase is not re-charged. Availability may vary by country or account. Use Restore purchases to recover an eligible purchase on the same Google account.

Cancellation and refunds

Google Play is the seller of record for Premium. Refunds and payment disputes are handled under Google Play's refund policies, and Google's own timeframes apply. Because Premium is a one-time purchase rather than a subscription, there is nothing to cancel to prevent future charges.

If Premium fails to unlock or restore and Restore purchases does not resolve it, contact us at founder@nikhilnelson.com within a reasonable period and we will help you fix the entitlement or support your refund request with Google. Nothing here limits any statutory right of withdrawal, cancellation, or refund you have under the consumer law of your country.

Google Play

FormBuddy is distributed through Google Play. Google is not a party to these terms, is not responsible for FormBuddy, and has no obligation to provide support for it. Your use of Google Play is governed by Google's own terms. Where Google Play's developer terms require it, Google and its affiliates are third-party beneficiaries of these terms and may enforce them against you.

Availability and changes to the app

Features may change to improve safety, compatibility, policy compliance, or performance. We do not promise uninterrupted availability on every device, and we may modify or discontinue the app or any feature. Core local data may be lost if you delete it, clear app storage, uninstall without a supported backup, or lose your device. Back up anything you want to keep by exporting it.

Changes to these terms

We may update these terms when the app, our service providers, or legal requirements change. The effective date above will be updated. For material changes we will give reasonable notice in the app or on the store listing before they take effect. Continuing to use FormBuddy after the effective date means you accept the updated terms; if you do not accept them, stop using the app and uninstall it.

Termination

You may stop using FormBuddy at any time by uninstalling it. We may suspend or terminate your right to use the app if you materially breach these terms, if required by law, or if we discontinue the app. On termination, the licence above ends and you must stop using FormBuddy; a validly purchased Premium entitlement remains associated with your Google account, and the sections on intellectual property, disclaimers, liability, and governing law survive.

Disclaimers

To the extent permitted by law, FormBuddy is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness accuracy, uninterrupted or error-free operation, merchantability, or suitability for a particular purpose. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

Liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, profit, or opportunity, arising from your use of FormBuddy. Our total aggregate liability arising out of or relating to FormBuddy is limited to the greater of the amount you paid us for Premium in the twelve months before the claim, or ₹1,000 (one thousand Indian rupees).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under non-excludable consumer protection law. If you are a consumer, you keep all rights granted to you by the mandatory law of your country of residence, and nothing in these terms overrides them.

Governing law and disputes

These terms and any dispute arising out of or in connection with them or with FormBuddy are governed by the laws of India, without regard to conflict-of-law rules. Subject to the paragraph below, the courts at Ernakulam, Kerala, India have exclusive jurisdiction.

If you are a consumer, this choice of law and forum does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may also bring proceedings in the courts of that country. Consumers in India may additionally approach the consumer forums available under the Consumer Protection Act, 2019.

Before starting formal proceedings, please contact us at founder@nikhilnelson.com so we can try to resolve the matter informally. Most issues are resolved this way.

General

If any provision of these terms is held unenforceable, the remaining provisions stay in effect and the unenforceable provision is modified to the minimum extent necessary to make it enforceable. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a transfer of the FormBuddy business, on notice, without reducing your rights. These terms, together with the Privacy Policy, form the entire agreement between you and us regarding FormBuddy and replace any earlier version.
